Full Dismissal Secured in Michigan Medical Malpractice Case Involving Postoperative Infection Claims

Cline, Cline & Griffin, P.C. attorney R. Paul Vance recently obtained a complete dismissal on behalf of a podiatrist and his practice in a Michigan medical malpractice case involving allegations of delayed diagnosis and treatment of a postoperative infection following foot surgery.
The plaintiff claimed that postoperative care fell below the standard of care during routine follow-up visits and that an alleged delay in recognizing an infection ultimately led to osteomyelitis and amputation of two toes. The evidence, however, supported the fact that there were no signs of infection during the care at issue, and subsequent providers initially noted no need for antibiotics.

Following discovery, Mr. Vance filed two motions for summary disposition, one addressing causation and the other challenging the admissibility of Plaintiff’s standard of care expert.
